PRICING
All prices are quoted in Australian Dollars. SunFX reserves the right to change prices without notice.
DELIVERY
SunFX Pro shall deliver the products to the place of delivery designated by Customer and agreed to by SunFX Pro Pty Ltd ("Place of Delivery").
Any dates quoted for the delivery of the products are approximate only. SunFX Pro shall not be liable for any delay in delivery of the products and/or services, howsoever caused.
SunFX Pro may revise and/or discontinue Products at any time without notice as part of SunFX's policy of on-going Product up-date and revision.
Australian Delivery
Delivery by SunFX Pro of any products within Australia will usually occur within 4 - 7 business days. However customers must also be prepared in the event of an early delivery date. When delivery cannot be made at a local address due to the absence of the householder or purchaser, sufficient notification by the transport company may be left, where and whenever possible, to inform them of the alternatives available and the possible redelivery as specified on the delivery notification.
International Delivery
International orders are subject to the delivery restraints of the available and nearest warehousing to that location and are thus subject to the limitations of these deliveries. Where possible delivery will be made within 10 - 14 days of the international order being placed. However problems due to international customs and other constraints out of our control may result in further delays to the delivery of the items.
FORCE MAJEURE
Neither party shall be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of the party so delaying, and such party shall be entitled to a reasonable extension of time for the performance of such obligations.
EXPORT RESTRICTIONS
The Customer acknowledges that the Products licensed or sold hereunder are not only subject to the export control laws and regulations of Australia but may also be subject to the export control laws and regulations of the country in which the Products are received. The Customer agrees to abide by all applicable export control laws and regulations. Under such laws and regulations, the Products purchased may not be sold, leased or otherwise transferred to restricted end-users or to restricted countries. In addition, the Products may not be sold, leased or otherwise transferred to, or utilized by, an end-user engaged in activities related to weapons of mass destruction, including but not necessarily limited to, activities related to the design, development, production or use of nuclear materials, nuclear facilities, or nuclear weapons, missiles or support of missile projects, or chemical or biological weapons. The Customer understands that applicable requirements or restrictions may vary depending on the Products delivered and may change over time and that, to determine the precise controls applicable to the Products acquired, it may be necessary to refer to relevant laws and regulations.
GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with both the Federal Laws of Australia and also the local laws pertaining to the Australian Capital Territory and shall be subject to the non-exclusive jurisdiction of the courts of the Australian Capital Territory.
RETURNS POLICY
GENERAL RETURNS POLICY
By shopping with SunFX you agree to the purchasing policies of SunFX as described in this policy.You may return new, unopened items sold and fulfilled by SunFX within 30 days of delivery for a full refund. Items should be returned in their original product packaging. We'll also pay the return shipping costs if the return is a result of our error.
REFUNDS OR EXCHANGES
You should expect to receive your refund within one week of us receiving the item into our warehouse. Items can be returned to either our warehouse location or our PO Box address as found on our contact page. Notification for return needs to be made by email or phone call to Head Office. You will then be given a special return identification number to be included in all correspondence. Without this number a return can not be made and a refund or exchange cannot be given.DAMAGED OR DEFECTIVE ITEMS
Did you receive a damaged or defective item? If you receive one of our body products and they are damaged or defective then, within 7 days of the order, we can arrange for either an exchange or refund upon the return of the items. If you have ordered one of systems and it has a damaged or defective part, we recommend that you contact us to see if they can have this part shipped directly to you. Please contact us and we will can recommend the best options of a return of the defective part or product and provide details on the delivery of the replacement. We'll ask you to indicate the number of items you're returning, the reason for return, and whether you would like a refund or a replacement item sent to you.Did you receive the wrong item or an item you didn't order? We'll ask you to indicate the number of items you're returning, as well as whether they arrived instead of or in addition to items that you did order. We will also ask you whether you need a refund or a replacement sent to you.

HOW SECURE IS INFORMATION ABOUT ME?
We work to protect the security of your information during transmission by using firewalls and Secure software, which encrypts information you input.We reveal only the last five digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing.
It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer.
Although SunFX uses industry standard practices to protect your personal information, due to technical limitations, we cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose information to the government or third parties under certain circumstances or third parties may unlawfully intercept or access transmissions or private communications. Therefore, although we use industry standard practices to protect your privacy, we cannot and do not guarantee, and you should not expect, that your personal information or private communications will always remain private.
